Terms of Service

These Terms govern your use of the PanSphere iOS app and companion website, provided by Borealbit Technology Limited (“Borealbit,” “we,” “us,” or “our”). By downloading, purchasing, or using PanSphere, you agree to these Terms.

1. The service

PanSphere is a digital handpan instrument with tuned scales, optional ambience, local session history, and optional Pro access. It is designed for music, creative exploration, and relaxation. It is not a physical handpan, recording studio, medical device, or therapeutic service.

2. License and acceptable use

Subject to these Terms and Apple's rules, Borealbit grants you a personal, limited, non-exclusive, non-transferable, revocable license to use PanSphere on Apple devices you own or control.

You may use PanSphere for personal or commercial musical performance, subject to applicable law. You may not reverse engineer, redistribute, resell, rent, interfere with, or misuse the app except where applicable law expressly permits it.

3. Free features and PanSphere Pro

The free experience includes 4 complete scales and core ambience. Pro unlocks 5 additional scales and the complete ambience mixer.

Pro is offered through Apple only as Pro Lifetime, a one-time non-consumable purchase for the current PanSphere app.

Available products, localized prices, taxes, eligibility, and offer terms are displayed by Apple before purchase. Website descriptions do not replace Apple's purchase sheet.

4. Purchase, restoration, and refunds

Payment is charged to your Apple Account when you confirm the Pro Lifetime purchase. It is a one-time purchase and does not auto-renew.

Apple processes billing, refunds, and restoration under Apple's policies. Borealbit cannot issue App Store refunds directly. Pro Lifetime applies to the current PanSphere app and does not promise separate future apps, services, or unannounced features.

5. Local data and availability

PanSphere stores session history and preferences locally and does not provide automatic CloudKit or iCloud synchronization. You are responsible for your device and backups. Deleting the app, clearing local history, device failure, or software changes may result in local data loss.

We may update, improve, suspend, or discontinue parts of PanSphere. We do not guarantee uninterrupted operation, compatibility with every device or audio route, or permanent availability of any App Store offer.

6. Music, sessions, and exports

You retain rights you already hold in musical performances you create while using PanSphere. The current release records session statistics, not microphone audio, and does not provide MIDI, session-file, or audio export.

7. Intellectual property and third-party materials

PanSphere, its branding, software, interface, and original assets are owned by Borealbit or its licensors. The app includes FreePats Hang D minor recordings distributed under CC0 1.0; source and license information is available in Settings → About → Audio Credits.

8. Health and safety

PanSphere is intended for music, creative exploration, and relaxation. It does not diagnose, treat, prevent, or cure any condition and is not medical advice. Use a comfortable volume, protect your hearing, and do not use the app when doing so would distract you from driving, operating equipment, or remaining aware of your surroundings.

9. Privacy

Our Privacy Policy explains how PanSphere handles local app information, Apple purchase services, the companion website, and support email.

10. Disclaimers

To the maximum extent permitted by law, PanSphere is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.

11. Limitation of liability

To the maximum extent permitted by law, Borealbit and its affiliates, officers, employees, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or use arising from PanSphere. Where liability cannot be excluded, it is limited to the amount you paid for PanSphere during the twelve months before the event giving rise to the claim, unless applicable law requires otherwise.

12. Changes and applicable terms

We may update these Terms when PanSphere or legal requirements change. The updated date appears above. Apple's standard terms and laws that apply to you may provide additional rights that these Terms do not limit.
